General Terms and Conditions (AG)
Practice Natural Thinker

Gertrud Frankenbach
Social worker and alternative practitioner, limited to the field of psychotherapy

As of October 2026

§ 1 Scope and offers

These terms and conditions apply to the individually agreed services of my practice.

My services are aimed at adult women, children and teenagers, as well as mothers with their children.

I offer psychotherapeutic treatments within the framework of my official license as a non-medical practitioner, as well as psychosocial and educational counseling and support.

The activities can include conversations, creative methods, nature experiences and encounters with animals, especially sheep and horses.

Depending on the agreement, the support takes place in individual appointments or in joint mother-child appointments.

Children and young people can also participate in agreed individual appointments without the presence of their parents or other accompanying persons.

Appointments can take place in the practice rooms, in nature, on the grounds of my animals or at another suitable location agreed upon beforehand.

Medical services are provided exclusively within the scope of my license to practice medicine, limited to the field of psychotherapy. I do not offer medical treatment for physical illnesses.

§ 2 Appointment scheduling and contract conclusion

Appointments can be requested by phone, email or via the contact options on my website.

A request for an appointment does not constitute a binding booking.

An appointment is considered agreed upon as soon as I have expressly confirmed it and the necessary contractual requirements have been met.

Before the start of a paid collaboration, I will inform you about the type, duration and fee of the agreed service.

In the case of minors, it is clarified in advance who is authorized to conclude the contract and to grant the necessary consents.

These terms and conditions will be provided before the conclusion of the contract.

§ 3 Initial consultation, information and consent

At the beginning of our collaboration, we discuss the specific request, expectations, and the possibilities of my support.

In psychotherapeutic treatments, the legally required information about the treatment, its essential risks, limitations and, if applicable, alternatives is provided.

The necessary consent will be obtained before the start of treatment.

For children and adolescents, their age, developmental stage and individual capacity to consent are taken into account.

Where necessary, the legal guardians will be involved in the explanation and consent process.

In cases of joint custody, it is examined which approvals are necessary for the respective measure.

I reserve the right to refuse, adjust, or interrupt an escort for professional or security-related reasons.

§ 4 Accompaniment of children and young people

Children and young people can be accompanied both together with their mother and in individual appointments without the presence of an adult companion.

Before the collaboration begins, the necessary approvals from the legal guardians will be clarified and obtained.

The legal guardians will provide me with the information necessary for safe supervision. This may include, in particular, any health conditions, allergies, important contacts, and emergency numbers.

The needs, personal boundaries and self-determination of the child are taken into account according to their age and stage of development.

During psychotherapeutic treatment, the legal rights of underage patients and the necessary confidentiality are respected.

Information from confidential conversations with minors is not automatically and completely disclosed to the parents. Legal regulations, particularly those concerning capacity to consent, confidentiality, and the protection of the child, are decisive.

§ 5 Supervision and handover of minors

For individual appointments without the presence of the parents, it is agreed in advance when and where the handover of the child will take place.

The agreed supervision begins with the personal handover or at the expressly agreed time.

It ends with the agreed handover to a person authorized to pick up the child or, if this corresponds to the child's age and stage of development and has been expressly agreed, with the child leaving the agreed meeting point independently.

The legal guardians will inform me who is authorized to pick up the child and whether the child is allowed to make the journey home independently.

For joint mother-child appointments, the distribution of supervisory responsibility is clarified in advance.

The statutory supervisory, due diligence and liability obligations remain unaffected.

§ 6 Nature and animal-related offers

Part of my work takes place in nature and in interaction with my sheep and horses.

Animals are independent living beings with individual needs and natural behaviors.

A specific behavior or reaction from the animals cannot be guaranteed.

Before participating, the clients and, if applicable, their legal guardians are informed about essential features and identifiable risks.

These include, for example, uneven terrain, weather conditions, allergies, and the unpredictable behavior of animals.

Direct contact with animals only occurs after appropriate instructions and approval.

The animals may not be fed, led or otherwise touched without prior consent.

Children are guided and supervised according to their age and individual needs.

The needs and boundaries of the animals are respected at all times.

In case of unsuitable weather, health or safety concerns, an appointment may be postponed or its format adjusted.

§ 7 Self-determination and personal boundaries

My work is geared towards the individual needs and possibilities of the people I support.

Every client is free to express their own boundaries and refuse individual exercises or offers.

Creative methods, body awareness exercises and encounters with animals only take place within the framework of the necessary consent.

Children and adolescents have their personal boundaries and developmental stage given special consideration.

No specific personal development trajectory or treatment success is guaranteed.

§ 8 Fees and Reimbursement of Expenses

My practice is a self-pay practice.

The costs for the agreed services are generally billed directly to the person contractually obligated to pay.

In the case of minors, it is agreed in advance who the contractual partner is and who is obligated to pay.

The duration of the appointments and the amount of the fee will be communicated and agreed upon before the start of the collaboration.

An invoice will be issued for services rendered.

Privately insured clients or their legal guardians can submit invoices for reimbursable medical services to their private health insurance company.

Whether and to what extent a reimbursement is made depends on the respective insurance contract and tariff.

Reimbursement cannot be guaranteed.

It is recommended to clarify eligibility for reimbursement directly with the insurance company before starting treatment.

The agreed payment obligation exists regardless of any possible refund.

Regular reimbursement of costs by statutory health insurance companies is generally not provided for my services.

The payment deadline is specified in the invoice or the individual fee agreement.

§ 9 Cancellations and No-Shows

Agreed appointments are binding.

If you are unable to attend an appointment, please let me know as soon as possible.

This also applies in the case of illness of a child or an adult client.

In the case of short-notice cancellations or no-shows, possible claims for compensation are governed by the legal provisions and the circumstances of the individual case.

These terms and conditions do not stipulate a flat cancellation fee.

Statutory rights of termination remain unaffected.

§ 10 Appointment cancellations by the practice

If an appointment cannot take place due to illness, force majeure, unsuitable weather conditions, security concerns or other important reasons, I will inform the affected persons in good time if possible.

If possible, an alternative date will be offered.

Payments already made for services not rendered will be refunded in accordance with legal regulations.

Further legal claims remain unaffected.

§ 11 Confidentiality and duty of secrecy

I treat personal information and health details confidentially.

For medical treatments, the relevant statutory confidentiality obligations apply.

When dealing with underage clients, their personal rights and the legal regulations regarding capacity to consent and confidentiality are respected.

Confidential information will only be disclosed to legal guardians or other persons to the extent that it is legally permissible or required.

Statutory disclosure rights and obligations, particularly in acute emergency situations, remain unaffected.

§ 12 Data Protection and Communication

Personal data is processed in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).

Health data is given special protection.

Further information on the respective processing purposes, legal bases, retention periods and data subject rights can be found in my separate privacy policy.

Appointment requests can be made by phone, email, or via the contact options on my website.

When making initial contact, only the necessary contact details and the desired appointment time should be provided.

Detailed health information should only be exchanged via a suitable, secure communication channel.

§ 13 Treatment documentation

In the case of medical treatments, documentation is carried out in accordance with legal requirements.

The statutory retention periods are observed.

Clients have the legally stipulated rights to inspect their treatment file and to receive copies.

In the case of minors, the corresponding rights and powers of the legal guardians are governed by the statutory provisions.

§ 14 Limits of treatment and emergencies

Psychotherapeutic treatments are provided exclusively within the scope of my official license as a non-medical practitioner, limited to the field of psychotherapy.

My services do not replace necessary medical, psychiatric, or other medical treatment.

In case of acute medical or psychiatric emergencies, the appropriate emergency care should be sought.

Nature-, animal- and creativity-related methods are used according to the agreed offer and their professional suitability.

A specific therapeutic outcome is not guaranteed.

§ 15 Liability

My practice's liability is governed by the statutory provisions.

Liability for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty is neither excluded nor limited.

I am fully liable for other damages in cases of intent and gross negligence.

In cases of simple negligence and breach of essential contractual obligations, liability for other damages is limited to the foreseeable damages typical for this type of contract, insofar as this is legally permissible.

Mandatory statutory liability claims as well as statutory supervisory and traffic safety obligations remain unaffected.

§ 16 Right of withdrawal

For psychotherapeutic treatment contracts as defined in Section 630a of the German Civil Code (BGB), the special statutory regulations apply. A general right of withdrawal for distance contracts pursuant to Section 312g of the German Civil Code (BGB) does not exist for such contracts.

For separately agreed services that do not constitute treatment contracts, in particular certain consulting or educational services, a statutory right of withdrawal may exist when concluding a contract via distance selling.

Where a right of withdrawal exists, the legally required information and a separate cancellation policy will be provided before the conclusion of the contract.

Statutory rights of termination remain unaffected.

§ 17 Termination of Cooperation

The cooperation can be terminated within the framework of the legal provisions.

Statutory rights of termination, particularly for services provided on the basis of special trust, remain unaffected.

Services already rendered will be billed in accordance with legal regulations.

In the case of minors, the contractual powers of the legal guardians and the rights of the child or young person are taken into account.

§ 18 Final Provisions

German law applies, subject to mandatory statutory consumer protection regulations.

For legal disputes, the statutory rules of jurisdiction apply.

Individual agreements take precedence over these general terms and conditions.

Mandatory legal rights of clients remain unaffected.
